2022 UPDATE: Our FATCA IGA Trial in Canada’s Federal Court of Appeal will be held in Vancouver BC on March 30, 2022. 

On August 11, 2014 Plaintiffs Ginny and Gwen filed a lawsuit against the
FATCA agreement in Federal Court of Canada. See the original Claims

We lost the Federal Court battle (Mactavish decision) and Appellants Gwen and Kazia are now appealing in Canada’s Court of Appeal. A Notice of Appeal was filed on September 30, 2019 and a Memorandum of Fact and Law submitted in December 2020.  Canada responds to our arguments in February 2021.  Federal Appeal Court trial and decision will happen in 2022.

Gwen and Kazia say that the Canadian FATCA turnover to U.S. IRS of private information of a subgroup of Canadian citizens – made only because of threat of harm by the U.S. – violates the Canada-U.S. Tax Treaty and Canada's Charter of Rights and Freedoms.

We expect that this case will only be resolved in the Supreme Court of Canada.
